These Terms of Service ("Terms") govern your access to and use of RightPen.ai ("RightPen," "we," "us," or "our"), including our website, web application, and all related services. By accessing or using RightPen, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Description of Service

RightPen is an AI-powered media analysis tool that allows users to upload screenshots of news articles and social media posts to receive analysis of potential bias, missing context, and suggested alternative framing. The service is intended for personal, non-commercial use as an informational and commentary tool.

2. Eligibility

You must be at least 18 years of age to use RightPen. By using the service, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

3. Accounts and Subscriptions

To access RightPen you must create an account and maintain an active paid subscription. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Subscriptions are billed annually at the rate in effect at the time of purchase. Founding Member rates are locked in for the life of the account as long as the subscription remains active. If a subscription lapses, the Founding Member rate is forfeited and the then-current rate applies upon resubscription.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods except as described in Section 9.

4. Acceptable Use

You agree to use RightPen only for lawful purposes and in accordance with these Terms. You agree not to:

Upload content that you do not have the right to submit
Use the service to harass, defame, or target any individual or group
Attempt to reverse engineer, copy, or replicate the service or its underlying technology
Use automated tools, bots, or scrapers to access the service
Attempt to circumvent any security or access controls
Resell, sublicense, or commercially distribute outputs from the service without written permission
Use the service in any way that violates applicable local, state, national, or international law

5. Content and Analysis

RightPen uses artificial intelligence to analyze submitted content. The analysis provided is intended for informational and commentary purposes only. It does not constitute legal, journalistic, factual, or professional advice of any kind.

AI-generated analysis may contain errors, omissions, or inaccuracies. You are solely responsible for how you use, share, or act upon any analysis provided by RightPen. We make no warranty that any analysis is accurate, complete, or free from bias.

By submitting content for analysis, you represent that you have the right to submit such content and that doing so does not violate any applicable law or third-party rights.

6. Intellectual Property

The RightPen name, logo, website design, and underlying technology are the intellectual property of RightPen.ai and are protected by applicable trademark and copyright law. You may not use our branding or intellectual property without prior written consent.

You retain ownership of any content you submit. By submitting content, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the analysis service.

Analysis outputs generated by RightPen are provided for your personal use. You may share these outputs for personal commentary, criticism, or educational purposes. You may not sell or commercially distribute outputs without our written permission.

7. Third-Party Services

RightPen relies on third-party services including Stripe for payment processing, Supabase for data storage and authentication, and Anthropic for AI analysis capabilities. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the actions or omissions of these third-party providers.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any analysis provided.

9. Refund Policy

We offer a 30-day money-back guarantee for new subscriptions. If you are not satisfied with RightPen within the first 30 days of your initial subscription, contact us at [email protected] and we will issue a full refund. Refund requests submitted after 30 days from initial purchase will not be honored except at our sole discretion.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RIGHTPEN.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless RightPen.ai and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any conduct we determine to be harmful to other users, third parties, or the service. Upon termination, your right to use the service ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Florida.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the service after changes are posted constitutes your acceptance of the updated Terms.
